Each rider and passenger over the age of 18 must complete their own waiver. You may not complete a waiver on behalf of another rider. Minor waivers will be available at the event for passengers under 18. 

Grit & Grace Participation Waiver and Release of Liability

In consideration for permitting Participant to ride in Grace Guest House, Inc.’s (“Grace House”) Grit & Grace motorcycle safety and awareness ride (“the Event”), the Participant, and if the Participant is less than 18 years old, the Participant’s parent or legal guardian (collectively, the “Participants”), for themselves and for their respective heirs, personal representatives, executors, administrators, and assigns, agree as follows:

1. Good Physical Condition. Participant hereby acknowledges and agrees that they are in good physical condition and have no disease or injury that would impair their ability to participate in the Event.
2. Licensed and Competent. If Participant is operating a motorcycle during the Event they hereby certify that they are licensed and competent to operate a motorcycle in a safe manner.
3. Assumption of Risk. Participant hereby acknowledges and agrees that they understand the nature of the Event and is participating voluntarily in the Event; that there are certain inherent risks and dangers associated with the Event, including but not limited to those caused by terrain, facilities, temperature, weather, condition of riders’ equipment, vehicular traffic, actions of other people including, but not limited to, organizers, participants, volunteers, spectators, agents, Grace House and its officers, directors and employees. Participant knowingly and voluntarily, accepts and assumes responsibility for each of these risks and dangers and all other risks and dangers, whether known or unknown, that could arise out of, or occur during, Participant’s participation in the Event even if such risks are due to the negligence of Grace House and/or their agents, officers, directors, volunteers, or employees.
4. Release and Waiver. Participant hereby releases, waives, discharges, and covenants not to sue Grace House, it officers, directors, employees, event sponsors and volunteers, and owners, operators and lessors of premises used to conduct the Event (collectively, the ‘Releasees”), from and for any liability resulting from any personal injury, accident or illness (including death), and/or property loss or damage however caused, even if caused by the negligence of Grace House and/or its officers, directors, agents, contractors, volunteers or employees, arising from or in any way related to Participant’s participation in the Event.
5. Indemnification and Hold Harmless. Participant hereby agrees to indemnify, defend and hold the Releasees harmless the Releasees, its successors and assigns, from any and all claims or actions and against all liabilities, losses, damages, counsel fees and other expenses from an action brought by Participant,or any third party, related to Participant’s participation in the Event.
6. Insurance. Participant hereby acknowledges that they currently have valid and sufficient medical and accident insurance. Participant understands that the foregoing is their sole responsibility and releases all persons and entities, including, but not limited to the Releasees, from providing coverage for the Participant.
7. Rules and Regulations. Participant acknowledges and agrees that they are not under the influence of any narcotic, alcohol or other drug that may impair their understanding or judgment and will not at any time during the Event operate their motorcycle under the influence of any such narcotic, alcohol or other drug. Participant further hereby agrees to comply with all rules and regulations of the road and guidance from safety personnel. Participant understands that its participation in the Event can be revoked at any time for inappropriate and/or unsafe behavior as determined by Grace House and/or the safety personnel assisting throughout the Event.
8. Likeness. Participant hereby agrees, without compensation, to allow their image, photograph, video reproduction or likeness to appear in publications, advertising, and/or television and online coverage in a manner incidental to their participation.
9. Severability. Participant expressly agrees that the foregoing assumption of risk, release and waiver of liability, indemnity and consent agreement is intended to be as broad and inclusive as is permitted by the law of the State of New York and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
10. Acknowledgment of Understanding. Participant has read this Participation Waiver and Release of Liability and has had the opportunity to ask questions about the same. Participant fully understand this assumption of risk, release and waiver of liability and indemnity agreement, and that they are giving up substantial rights in connection therewith, and that its terms are contractual, and not a mere recital. Participant acknowledges that they are agreeing to this Participation Waiver and Release of Liability freely and voluntarily and that no oral representations, statement, or inducements, apartment from the foregoing written agreement have been made.
